MUMBAI, 14 JUNE, 2021 (GPN): A Cidco official on condition of anonymity revealed to GPN news network that Cidco had issued an ultimatum to Airoli Sports Association (ASA) almost 3 year back seeking the termination of the original lease agreement and taking the allotted land back in its possession for failing to comply to its show cause notice that Cidco had issued to ASA in the year 2017. After the much hyped negotiations the ultimatum has been kept under the carpet and settled in gray owing to the condition laid on ASA by Cidco to provide concessional memberships to some concerned nominated Cidco employees for the settlement. Although the lease holder can’t go beyond the terms and conditions appended in the lease agreement, Cidco has been lenient in it’s legal course for personal gains of it’s employees and not much for the technicality and ethicality of the issue.

The case had come in the limelight when TOI and other newspapers had published an article on this issue, which was never further covered and researched with a follow up storyline due to manipulation by the parties involved.

NAVI MUMBAI (TOI): Cidco has issued an ultimatum to Airoli Sports Association (ASA) seeking termination of agreement and taking the allotted land back in its possession for failing to comply to its show cause notice issued in November last year. 

Cidco has alleged that the lease agreement has been violated as the 2,500 sq m land was leased out to ASA in 2011 for the purpose of sport activities but a major part of the land has been converted into space for commercial activities. A hearing about the alleged breach of conditions of the agreement to lease for plot number 107 in sector 8A, Airoli, is likely to take place within a fortnight for further action.

Cidco sources said ASA has violated conditions in the lease agreement by creating an illegal restaurant and bar apart from entering into a third party agreement with a private agency for the set-up without its prior permission.

“During our visit to the sports complex it came to light that the facility is being managed by a third party called Shirke Club Management LLP. It seems that the lease holder ASA has entered into unauthorised and illegal agreement with the third party which is beyond the lease clause.

This prompted us to issue a show cause notice as well as reminder for action,”  Karan Shinde, Cidco estate officer told TOI.

According to Cidco, the plot was given on 60 years lease for the sole purpose of setting up a sports complex by ASA.Dr Hemant Anarthe, secretary of ASA, said, “We have already complied with the details as per show cause notice. The matter will be resolved soon and we are taking corrective measures as per the lease clauses.”

Shinde added that “The compliance report submitted by ASA is incomplete which is why we dashed a reminder for appropriate submission. We have asked for an agreement copy between ASA and the third party,” said Shinde.

The restaurant, bar and banquet hall are illegal because the plot was allotted for sports and related activities not for commercial exploitation. “We will fix the date of hearing within 15 days from now which will decide the course of action like revoking lease agreement and taking possession of the plot,” added Shinde.

ASA has been instructed to submit the financial audit report for the last five years and provide concessional memberships to nominated Cidco employees which have not been adhered to.

Faiyaz Khan, manager of town services, Cidco told TOI, “ASA is under our radar. Our legal team has been examining the matter before taking strict actio. The lease holder can’t go beyond the terms and conditions appended in the lease agreement.”

In 2013, Shashi Prabhu & Associates, A design firm, headquartered in Mumbai, with it’s Seven other office locations including UAE and Africa, were approached to work on the renovation and expansion of the Airoli Sports Complex. The existing complex was small and inadequate. Few visionary citizens got together and convinced CIDCO to allocate a plot to develop sporting facilities. They invited private partnership to co-develop this complex. New complex was scheduled to have facilities like badminton, squash, TT, gymnasium, restaurants, health club, swimming (roof top), residential rooms, etc. Additionally, a proposed banquet and business centre were also part of the expansion plan.

We chalked out a detailed plan around the concept of modernism. Modernism is a philosophical choice that involves exercising the mind to break the traditional boundaries of design by experimenting with forms and colors, while maintaining the function of the intended space.

Being a small square parcel of land, the planning of the sports complex had to be efficient. We achieved space maximisation by using maximum floor plate and vertical stacking and incorporating maximum indoor activities occurring in any other spread out plan on larger plots.

The exposed wooden criss-cross slates ceiling with slate stone texture wall and eco-lighting is extremely eye catching in the main restaurant.

Sashi Prabhu comments, “While the plot size made us plan even more meticulously with regards to utilising the available space, it was extremely challenging to accommodate the swimming pool. The sports lighting was something we experimented with a lot, to get the right vibe.”

This project was completed on May 2017 at a total cost of INR 85 Cr. ENDS
