MY APPEAL TO INVESTORS AND VICTIMS TO RAISE THEIR VOICE AGAINST SUCH DEFAULTERS 

MUMBAI, 4 NOVEMBER, 2020 (GPN): Arnab Goswami, Editor of Republic TV, has been arrested by the police. Raigad police have arrested Arnab Goswami from his Mumbai home. According to the architect, this action has been taken in the Naik suicide case. Arnab's arrest has resumed discussions on the Anvay Naik suicide case. This is the background to this case.

Anvay Naik, a 52-year-old interior designer from Mumbai, committed suicide on May 5, 2018 at Kavir near Alibag. Alibag police have registered a case against three persons, including Arnab Goswami of Republic TV, for inciting suicide. He was disappointed that Arnab and two others had exhausted Naik's money. Shockingly, the body of Naik's 73-year-old mother Kumud was also found in the house at the same time.

A case under Section 306 was registered against Naik's wife Akshata Naik at Alibag police station after the suicide. Naik had written the names of Arnab Goswami, Feroze Sheikh and Nitesh Sarda in his letter before committing suicide. The then Superintendent of Police Anil Paraskar had informed that a case was registered against the three on a complaint lodged by Naik's wife.

Suicide itself is a heinous crime. It depends how the case unfolds. Already there is lot of controversy and politics over SSR Suicide case and now the Suicide of Mother Son duo.
Why is the Law so frail and weak on money defaulters. The Law is also equally responsible for this suicide. Firstly the Judges should be also jailed.


One such case is of Royal Twinkle Star Club and Citrus Check Inns Owner and Accused, Omprakash Bansantlal Goenka, who is  the mastermind of the fraud and scam to the tune of 7500 Crore of Investors Money. With more than 5 Lakh Investors and victims of the ponzi scheme left in lurch by the Court and Sebi who bailed out the main accused. I myself and my wife had invested 7 Lacs in this scheme and fall victims to this scheme as my wife could not take the pressure and succumbed to the hardships we had to face by running pillar to post to get back our hard earned money her life ended with a heart attack under the pressure.I belong to the middle class family, will the police and court take action only after we die or commit suicide? Is the question every investor and victim ask.

An offence had already been registered against Goenka and his partners — Prakash Uttekar, Natarajan Aiyyar and LS Kotnis — under sections 406, 409, 402, 120(B) of Indian Penal Code for criminal breach of trust, criminal breach of trust by public servant, cheating, and criminal conspiracy. They were also slapped with the relevant charges under the Maharashtra Protection of Interest of Depositors (In Financial Establishment) Act, 1999.
While director Omprakash Basantlal Goenka, 69, who ran the scheme along with promoters Prakash Ganpat Utekar, Venkatraman Natarajan, and Narayan Shivram Kotnis are freely enjoying their lives today with the bail granted to them by permission of the trial Court.
(vi) The Appellant shall cooperate in the investigation and shall not try to contact or infuence the prosecution witnesses;
(vii) The Appellant shall visit Economic Offences Wing, Mumbai on every Sunday between 11.00 am to 2.00 pm.
(viii)Needless to state that in case of any breach of the conditions imposed hereinabove, the prosecution will be at liberty to move for cancellation of bail.

The arduous delay of more than two years to recover money from the ponzi scheme run by Royal Twinkle Star Club and Citrus Check Inns may get extended with (Retired) Justice JP Devadhar, the recently nominated head of Sale Monitoring Committee (SMC) recommending auction of the asset through SEBI rather than by SMC.
